Thank you for contacting me regarding Assembly bill 4172. I appreciate your taking the time to share your views on this subject.



As you may know, I am the Primary Sponsor of Assembly bill 4172. I certainly understand your concerns regarding the extent to which this bill would regulate off-road vehicle use in the state, and have been working closely with the Motor Vehicle Commission, the NJ Off-Highway Vehicle Association (NJOHVA), the Department of Environmental Protection, and the Pinelands Preservation Alliance to address many of the issues facing both the environmental and off-highway vehicle communities. While it may seem that restrictions and regulation deem off-road vehicle riders as criminals, I can assure you that this is not the intent of the legislation.



On December 6th, the bill was reported favorably out of the Assembly Transportation Committee. It is important to note that A.4172 is still at an early stage in the legislative process and further meetings are planned to address issues of registration and obtaining land for off-highway vehicle parks. Notwithstanding, I will certainly keep your views in mind as A.4172 makes its way through the legislative process.

Please allow me to acknowledge receipt of your recent e-mail expressing concerns about A4172, a bill which would establish new penalties for illegal operation of certain vehicles on public lands and revise the law concerning registration, insurance, and operation of all-terrain vehicles and snowmobiles. The bill is pending in the Assembly Transportation and Public Works Committee. No companion Senate bill exists. It is unlikely that the bill will pass during this lame duck session.

I appreciate hearing from you and knowing of your concerns. In my district, the issue of ATV riding on public streets is a serious issue. Not only do riders practice their hobby often enough to disturb the peaceful enjoyment of people’s homes, they ride carelessly and recklessly as to endanger the safety of the public. One woman was killed when an ATV rider plowed into her on a public street. The local police departments have reported to me concerning the difficulties they have encountered in keeping these vehicles off the public roads. I have been in constant communication with the Department of Environmental Protection (DEP) regarding efforts to produce regulations on public riding areas. The DEP recently announced a grant award to the Atlantic Off-Highway Vehicle Park, Inc. to establish a new riding area in Ocean County for off-highway vehicle enthusiasts. According to the DEP, thirty percent of funding from the Federal Highway Administration’s Recreational Trails Program is allocated for motorized trail recreation.

I am certain that with your continued input regarding this and other issues of importance, we can better collaborate and develop policies that we all can appreciate. Please be assured that your concerns will be carefully considered when the legislature has the opportunity to address this issue.

I all the phone numbers, and e-mailed that letter and I have received 42+ e-mails back!!! Let's keep at it!!! Also, Senator Connors is in my District, I have spoken, and also written to him.
